U.S. states allege broad generic drug price-fixing collusion

U.S. states move to expand generic drug price-fixing lawsuit U.S. states move to expand generic drug price-fixing lawsuit Tue, Oct 31, 2017 21:41 hrs ----By Karen Freifeld WASHINGTON (Reuters) - A large group of U.S. state attorneys general on Tuesday sought to expand a lawsuit alleging price fixing of generic drugs to 18 companies and 15 medicines on Tuesday, including Novartis AG's generic unit Sandoz and India-based Sun Pharmaceutical Industries Ltd. The lawsuit, brought by the attorneys general of 45 states and the District of Columbia, describes an industry-wide conspiracy in which companies divide up the market as a way to push up prices. "It is our belief that price-fixing is systematic, it is pervasive, and that a culture of collusion exists in the industry," Connecticut Attorney General George Jepsen, who is leading the case, said at a news conference on Tuesday. The original complaint, filed in December, targeted Emcure Pharmaceuticals' unit Heritage Pharmaceuticals Inc, Aurobindo Pharma USA Inc, Citron Pharma LLC, Mayne Pharma USA Inc, Mylan Pharmaceuticals Inc and Teva Pharmaceuticals USA Inc. The states are now seeking to file a new complaint that would add Sandoz, Sun, Endo International PLC's unit Par Pharmaceutical, Dr. Reddy's Laboratories, Apotex Corp, Glenmark Generics Ltd, Lannett Company Inc, Alkem Laboratories Ltd's unit Ascend Laboratories and Cadila Healthcare Ltd's unit Zydus Pharmaceuticals Inc. The new complaint would also sue Rajiv Malik, president and executive director of Mylan, and Satish Mehta, chief executive officer and managing director of Emcure. Big players in the multi-billion dollar generic drug industry stand accused of conspiring to boost prices in a marketplace intended to deliver lower prices to consumers. The original lawsuit centered on just two medicines: a delayed-release version of a common antibiotic, doxycycline hyclate; and glyburide, an older drug used to treat diabetes. According to Jepsen's office, the amended complaint expands the number of drugs to include glipizide-metformin and glyburide-metformin, which are among the most commonly used diabetes treatments. Others include: acetazolamide, which is used to treat glaucoma and epilepsy; the antibiotic doxycycline monohydrate; the blood pressure medicine fosinopril; the anti-anxiety medicine meprobamate; and the calcium channel blocking agent nimodipine. The U.S. Department of Justice is conducting a parallel criminal investigation. On Friday, the department asked the Pennsylvania court presiding over the lawsuit to put the lawsuit's discovery process on hold, saying it could interfere with the criminal probe. Connecticut Assistant Attorney General Joseph Nielsen said Tuesday that the states would likely oppose that request, which could slow the lawsuit. Insys founder Kapoor steps down as Akorn chairman after arrest Insys founder Kapoor steps down as Akorn chairman after arrest Wed, Nov 01, 2017 00:41 hrs NEW YORK (Reuters) - John Kapoor, the billionaire founder of opioid maker Insys Therapeutics Inc , has resigned as chairman of drugmaker Akorn Inc , just days after his arrest on charges he participated in a scheme to bribe doctors to prescribe a potent pain medication while he was at Insys. Akorn, in a regulatory filing on Tuesday, said that Kapoor had resigned on Monday as chairman and a director of the company, and said director Alan Weinstein was named to replace him as chairman. Kapoor, who is Insys' majority shareholder, was charged last week with engaging in conspiracies to commit racketeering, mail fraud and wire fraud in an indictment filed in federal court in Boston. Kapoor’s lawyer did not immediately respond to a request for comment. Last week, he said in a statement that Kapoor is innocent and will fight the charges. Kapoor had stepped down as chief executive of Insys in January. Insys' shares slumped to a more than four-year low on Tuesday after resuming trade. The shares had been halted since Thursday, the day Kapoor was arrested. In Tuesday afternoon trading, the shares were down 9.5 percent at $5.19, after earlier falling 28.6 percent to $4.10. I-League clubs in the dark after high court ruling on Praful Patel

I-League clubs in the dark after high court ruling on Praful Patel

The immediate future of the I-League is the biggest concern arising out of Tuesday's Delhi High Court ruling on Praful Patel. The ruling has set aside All India Football Federation (AIFF) president Patel's election last December and appointed former Chief Election Commissioner SY Quraishi as administrator. "The people losing out the most are those involved with the I-League, junior football and grassroots development," Ranjit Bajaj, owner of I-League club Minerva Punjab told ESPN. "My only concern is that I hope Dr. Quraishi will understand that 10 clubs and the livelihood of 350 players are dependent on how soon he understands the distinction between the league and the ISL." I-League is still the officially-recognized league of India and is meant to be the qualifier for India's solitary slot to the Asian Football Confederation (AFC) Champions League. Shrinivas Dempo, owner of Dempo Sports Club, however, says the ruling won't affect the I-League. "I don't think the court's decision will have too much of an impact on the functioning of the I League," he told ESPN. "In much the same way that the Supreme Court's decision on the office-bearers of the BCCI didn't have an impact on the scheduling of the Indian domestic cricket tournaments, I believe the AIFF will also manage to function until the next elections are held." ESPN understands that the proposed fixtures list for the I-League -- meant to run concurrently with the Indian Super League (ISL) that starts on November 17 -- was supposed to get finalised this week, but club owners and officials now fear that the decision could get delayed. ESPN tried to contact AIFF officials, but they refused to answer any queries about the same. "With the consistent delays in the announcement of fixtures, it has become impossible to plan for the season," said one club official. "Forget seeking sponsors, or marketing and publicising your fixtures to get good crowds in, how do you prepare your team physically? Do you play practice matches or do you do high-intensity training and periodisation? The ambiguity around it doesn't allow you to implement plans." Bajaj says it is the preference for the ISL over the I-League that is the problem, labelling the treatment given to the ISL by the AIFF as "unfair". "Preferential treatment is being given to the ISL. When somebody asks for a comparison between the ISL and the I-League -- in terms of the sponsorships, marketing push and attendances -- I find it ridiculous because the ISL gets all the support from the AIFF," Bajaj said. The ISL is an entity that the AIFF is part-stakeholders in -- along with IMG-Reliance and the official broadcasters of the league -- and is hence unlikely to feel any impact of the court ruling. While one club official felt that Tuesday's ruling could pave the way for someone with football expertise, like former India captain Bhaichung Bhutia, to get into AIFF administration, the official felt it would be difficult to work around the politics at play, saying, "If Bhaichung chooses to stand for AIFF president, the public would support him wholeheartedly, but how will he get votes without the support of individual state associations?" "Why not have a CEO and run the federation like a corporate entity? We must take football out of politics," said the official. "The real work should be done by the CEO who has clear-cut objectives that relate to the performance of the national team, smooth functioning of the league and other such matters. If the objectives are met on a regular basis, then good, or else he or she gets fired." (With inputs from Jonathan Selvaraj)
